I maintain that the fundamental problem with "Enlightenment" was to equate 'reason' with rationality. In said Enlightenment reason proceeds from secular beliefs, such as a secular belief in equality or "Natural Rights." Beliefs, be they sacral/theological or secular/ideological, proceeding from any a priori or transcendental anything, are extra-rational. For a strictly rational approach to justice no beliefs can be involved.
