I acknowledge that restricting the right to bear arms on the basis that the Congress never created a militia is debatable, but it cannot be dismissed out of hand, either. That the Second Amendment links the right to bear arms to a militia and a militia to "the security of a free State" (clearly meaning a sovereign, independent nation-state) cannot be without significance for that right.
